The Washington State Senate has passed Senate Bill 5855 (SB 5855), a measure that prohibits law enforcement officers—including local, state, federal, and tribal agents—from wearing opaque face coverings while on duty and interacting with the public. The bill advanced on a party-line vote of 30-19 on January 28, 2026, with Democratic favor and Republicans opposed.

Sponsored by Sen. Javier Valdez (D-Seattle), the legislation strengthens existing state law requiring officers to be reasonably identifiable through displayed names or other information. It specifically bans items such as balaclavas, tactical masks, gaiters, ski masks, and similar opaque coverings that conceal the face. Exceptions are provided for clear or translucent face shields, medical masks, respirators in hazardous conditions, helmets for transportation, and limited uses like undercover operations or SWAT activities.
The bill allows individuals detained by an officer violating the prohibition to sue the officer in their official capacity for damages, aiming to enhance accountability and transparency.
Context and Motivation
The push for SB 5855 comes amid heightened concerns over federal Immigration and Customs Enforcement (ICE) tactics under the Trump administration. Reports have highlighted incidents where masked ICE agents conducted detentions and operations in Washington and other states, raising fears among immigrant communities about intimidation and lack of accountability. Supporters argue that face coverings create an atmosphere of anonymity that undermines public trust, especially in routine interactions.
Washington Gov. Bob Ferguson publicly endorsed the bill, stating on social media that “federal agents are roaming around with masks” and emphasizing that such practices are unacceptable in the United States. He urged swift passage so he could sign it into law.
The measure is part of broader Democratic efforts in the state to counter aggressive federal immigration enforcement, including protections for immigrants and restrictions on cooperation with federal authorities.
Opposition and Potential Challenges
Republicans opposed the bill unanimously, with critics arguing it could endanger officers by exposing them to threats, doxxing, or retaliation from criminal elements like cartels. Some described it as political posturing aimed at the Trump administration rather than a practical public safety measure.
The Trump administration has defended masked agents, citing needs for personal protection amid reported death threats and harassment. Federal law may preempt state restrictions on ICE operations, potentially leading to legal challenges if the bill becomes law—similar to ongoing disputes in other states like California.
The bill now heads to the Washington State House for consideration, where it will require approval before reaching the governor’s desk.
This development reflects deepening tensions between state-level transparency initiatives and federal immigration priorities in 2026.
